The Responsible Data Center Development Act (S10642 / A11560) would impose a one-year moratorium barring the Department of Environmental Conservation from issuing permits or approvals to any large data center with peak electrical demand of 20 megawatts or more, exempting modifications of existing permits and facilities that began construction before the effective date. Sponsored by Senator Kristen Gonzalez, it passed both the Senate and Assembly on June 4, 2026. As of August 17, 2026 it had not been signed by the Governor, who instead issued a separate executive order; its status is passed-both-houses and awaiting gubernatorial action.
